Terms of Service

1. Introduction and Scope

These Terms of Service ("Terms") govern your access to and use of Arc Traiders ("Platform"), operated by Akin Özdemir, Pfarräcker 3, 71336 Waiblingen, Germany ("Operator", "we", "us").

By accessing or using the Platform, you agree to be bound by these Terms. The Platform offers a venue for users to list and communicate regarding virtual items related to the game "Arc Raiders". The Platform does not facilitate, broker, or enable the conclusion of legally binding contracts between users via the technical infrastructure of the Platform itself.

2. Platform Role and Nature of Services

2.1. Venue Only; No Party to Transactions

Arc Traiders is strictly a technical venue for users to communicate and arrange trades. We are not a party to any transaction between users. Any agreement, trade, or exchange of virtual items or services is concluded exclusively between the participating users.

We do not own, sell, buy, store, or escrow any items listed on the Platform. We do not guarantee the existence, quality, safety, or legality of items advertised, the truth or accuracy of listings, or the ability of users to complete a transaction.

2.2. Trust Scores and Reputation System

The Platform may display "Trust Scores", "Reputation Levels", or similar indicators. These scores are non-binding informational indicators based solely on community reports and user interactions.

You explicitly acknowledge and agree that:

• Trust Scores are not factual statements about a user's character or reliability.
• They are not guarantees, endorsements, or certifications by the Operator.
• Community reports used to calculate scores may be false, incomplete, abusive, or inaccurate.
• A high Trust Score does not guarantee a successful trade, and a low Trust Score does not definitively prove malicious intent.

The Operator assumes no value judgment regarding users. We do not pre-verify reports. You are solely responsible for your own trading decisions. The Operator accepts no liability for any decisions made by you or others based on Trust Scores.

Users who believe their Trust Score is inaccurate due to abusive reporting may request a review. The Operator will examine such requests within a reasonable timeframe. However, the decision to correct a score lies within the sole discretion of the Operator.

2.3. Premium Features

Users may purchase "Premium" status or features. Premium features constitute solely a paid access to enhanced platform functionality (e.g., visual highlighting, advanced filtering).

The purchase of Premium features establishes a separate contractual relationship strictly for the provision of these technical features. Usage of Premium features does not verify, guarantee, enforce, secure, or influence the outcome of any transaction between users. It does not imply endorsement of the user by the Operator.

3. User Obligations and Account

You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities that occur under your account.

You agree not to:

• Violate any applicable laws or third-party rights (including intellectual property rights).
• Submit false or misleading information in listings or reports.
• Manipulate the Trust Score system (e.g., through "review bombing" or fake accounts).
• Use the Platform for fraud, money laundering, or other criminal activities.

4. Moderation, Suspension, and Termination

The Operator reserves the right to moderate content and suspend or terminate user accounts for violations of these Terms. Moderation measures and enforcement are exercised at reasonable discretion, taking into account the legitimate interests of the affected users.

In the event of account termination effectively caused by a user's breach of these Terms, there is no right to a refund of fees paid for Premium features, unless mandatory law provides otherwise.

5. Limitation of Liability

5.1. The Operator is liable without limitation for damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty by the Operator or its legal representatives or agents.

5.2. The Operator is also liable without limitation for damages caused by intent or gross negligence.

5.3. In cases of simple negligence, the Operator is liable only for the breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfillment is necessary for the proper execution of the contract and on whose compliance the user may regularly rely. In such cases, liability is limited to the typical, foreseeable damage.

5.4. Any further liability of the Operator is excluded. This limitation of liability also applies to the personal liability of the Operator's employees, representatives, and agents.

5.5. The Operator is not liable for data loss unless the user has secured their data through regular backups appropriate for the risk.

6. Final Provisions

6.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

6.2. Dispute Resolution. The European Commission provides a platform for Online Dispute Resolution (ODR) at https://ec.europa.eu/consumers/odr. We are not obligated and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

6.3. Severability. Should individual provisions of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
